Providing incomplete information during a competition investigation

The European Commission fined French artificial turf manufacturer Eurofield SAS and its parent company Unanime Sport SAS approximately EUR 172,000 for providing incomplete information in response to a request for information during a competition investigation.

After the European Commission announced the opening of an investigation into suspected procedural infringements related to the provision of information, the companies agreed to cooperate with the Commission, resulting in a 30% reduction of the initially proposed fine.

This was the first (and likely not the last) fine imposed by the European Commission for providing incomplete information under Article 23(1)(b) of Council Regulation No. 1/2003.

If acompany receives a request for information from the European Commission or the Czech Competition Authority, it is therefore crucial to treat the requestseriously and to respond with the utmost care to ensure that the information provided is complete and not misleading.
